The Case Against Amendment To The Criminal Procedure (Identification) Bill

The UAPA was misused extensively against those who opposed the government. The Criminal Procedure (Identification) Bill sets out on the same path.

Mahua Moitra, the Trinamool Congress (TMC) Member of Parliament, is famous for her speeches in the Lok Sabha. The first time she spoke in Parliament, her speech went viral. The lawmaker outlined the early signs of fascism that the Bhartiya Janata Party (BJP) showed during their rule. Since then, she has been unstoppable. Her speeches are fiesty, fiery attacks on the government and the laws they try to introduce, including the recent one against the Criminal Procedure (Identification) Bill, 2022.

This Bill is an update of the Criminal (Procedure) Identification Act created by the British government in 1920. The British collected the handprints, footprints and photographs of convicted or sometimes non-convicted persons. The updated version plans to use new technology that enables them to collect retina scans, physical samples and even signatures. This Bill, therefore, intrudes privacy in fundamental ways.

To talk about privacy these days is a bit tricky. Consider how easily we allow cookies on websites, how we upload photos and videos of our day-to-day lives on social media, and how easily we give access to our data to said social media. This could lead to privacy breaches by unknown parties. There have been countless incidents over the years. The difference is that, to some extent, this kind of intrusion can be controlled. The information we put out is in our hands, and there are still laws that prevent or punish those who collect data in an unauthorised manner.
